Terms & Conditions

For the purchase of Elm Leaf products:

In these Conditions Elm Leaf Ltd is called "the Company", "the Goods" means the goods the subject of the Contract between the Company and the Customer.

The Company reserves the right to amend these Conditions and/or its Price List on its website.

  • No order will be processed by the Company until the payment has been received in full and cleared funds. Payment may be made by any of the methods detailed on the elm leaf website.

  • Once we have accepted the Customer’s order, the Customer may not cancel it, unless agreed with the Company by e-mail.

  • It is the responsibility of the Customer to satisfy itself that the Goods ordered are suitable for the purposes for which the Customer requires them.

  • In those cases when the Company is not able (for whatever reason) to despatch then the Company will inform the Customer within 5 working days of receipt of the order with the reason for non despatch, and offer a later despatch date or, alternatively, a full refund.

  • The Company shall be liable for damage or loss of the Goods in transit.

  • The risk in respect of all Goods supplied shall pass to the Customer upon delivery.

  • The ownership of the Goods passes to the Customer on delivery of the Goods.

  • Delivery shall be deemed to have been effected when the Goods are handed over to the Customer or an agent of the Customer appearing to have the authority to receive them or as otherwise stated in the order.

  • The Company will use all reasonable endeavours to have the Goods delivered within 10 working days of receipt of the order. For the Christmas period, 18th Dec - 1st Jan, this time is extended to 19 working days.

  • Any delivery times and dates the Company gives are given in good faith but are only approximate. The Company will make all reasonable efforts to deliver the Goods in a reasonable time but will not be liable for any claim of compensation, of any description, that may result from delivery being delayed due to reasons beyond the Company’s reasonable control. If delivery is delayed beyond 10 working days (or 19 working days during the Christmas period, 18th Dec - 1st Jan) after the receipt of the order, not due to any act or omission by the Customer, the Customer may cancel the order by notifying the Company as soon as possible, and, in turn, will receive a full refund. Such notice should be confirmed by e-mail. If the ordered goods arrive after cancellation, the Customer must return these goods to the Company and bear the cost of return.

  • The Customer may cancel the contract for the Goods at any time within 5 working days of the date of delivery of the Goods by giving notice to the Company. In this case the Customer must return the Goods to the Company and bear the cost of return.

  • Nothing in these Conditions will effect or reduce the Customer’s legal rights in respect of faulty or misdescribed goods.

  • These Terms and Conditions cover the United Kingdom and Eire. Any orders received from outside those countries are accepted on the sole discretion of the Company, and may be subject to additional or amended conditions, which will be notified to the Customer, when the order is acknowledged.
